Public Notice
Pursuant to Title 17, Chapter 1, Section 1080 of the Illinois Administrative Code, notice is hereby given that Troy Mertz of Gilberts Development LLC, 1834 Walden Office Square, Suite 300 Schaumburg, Illinois 60173, has submitted a Conservation Plan to the Illinois Department of Natural Resources to apply for authorization for the taking of Blanding’s Turtle (Emydoidea blandingii) incidental to the Conservancy Neighborhoods 5-11.
The project is in Kane County, Illinois. The subject property is located north of Freeman Road, south of Huntley Road, east of the Union Pacific Railroad, and west of Galligan Road in Gilberts, Kane County, Illinois. Geographically the site is located within Sections 2 and 11, T42N, R7E; 42.136277°N, -88.376715°W; Huntley quadrangle. (See attached map).
The Project consists of the completion of a master planned residential development that began in 2006. Take of Blanding’s Turtle (Emydoidea blandingii) may result during the project as a result of this work. Blanding’s Turtle is protected under the Illinois Endangered Species Protection Act (520 ILCS 10) and is known to occur within the vicinity of the Project.
In order to minimize and mitigate for the take of Blanding’s Turtle (Emydoidea blandingii) incidental to Conservancy Neighborhoods 5-11. The development will be constructed within existing agricultural areas, where turtle habitat is not present. To decrease the chance of a turtle encountering a construction activity, active construction areas will have trenched silt fence installed along the perimeter of each neighborhood to prevent migration. A trenched double row silt fence will get installed on the edges of all preserved upland/wetland areas and ditches within each neighborhood as standard. Each neighborhood will be constructed individually as the Conservancy Development will not be mass graded at one time. Turtle inspection will occur during species active periods from March to November. Silt fence will be inspections that will occur daily during the active season. weekly or after every 0.5” rain event. Please review the included Conservation Plan.

The Conservation Plan will be available for public review within the model homes of the Conservancy Project. A copy will also be available at the Randall Oaks Public Library at the Circulation desk located at 500 N. Randall Road, West Dundee Illinois 60118. The Conservation Plan is also available on the Illinois Department of Natural Resources Incidental Take Authorization website, accessed at
