LEGAL NOTICE PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Geneva Planning and Zoning Commission has received an application for a public hearing from Oberweis Dairy for amendments to the Fabyan Crossing Planned Unit Development. This request is related to the development of a portion of the parking lot directly east of At Home for a sit-down and drive-through restaurant at Fabyan Crossing, legally described as follows: LOTS 1, 2, 4 AND 5 IN FABYAN CROSSING, IN THE CITY OF GENEVA, ACCORDING TO THE FINAL PLAT OF SUBDIVISION RECORDED NOVEMBER 8, 1993 AS DOCUMENT 93K88419 IN THE CITY OF GENEVA, KANE COUNTY, ILLINOIS. [INCLUDING PINS: 12-17-226-003 TO 006] LOTS 1 AND 2 OF GARNER'S RESUBDIVISION OF LOT 3 IN FABYAN CROSSING, IN THE CITY OF GENEVA, ACCORDING TO THE PLAT OF RESUBDIVISION RECORDED MARCH 27, 2006 AS DOCUMENT 2006K032321 IN THE CITY OF GENEVA, KANE COUNTY, ILLINOIS. [INCLUDING PINS: 12-17-226-19 AND 12-17-226-020] THE APPLICANT IS REQUESTING Preliminary Planned Unit Development amendments to the Fabyan Crossing Planned Unit Development for modifications to the approved parking ratio, final landscape plan, site plan, faade signage and to construct and operate a sit-down/drive-through restaurant on Lot 1. Specifically, the applicant is requesting the following: oAmend the Fabyan Crossing Planned Unit Development Permitted Uses for the Commercial Tract to allow a sit-down and drive-through restaurant on Lot 1 as a permitted use; oAn amendment to the Faade Sign Standards originally adopted by Ordinance 1993-45, Exhibit X and subsequently amended by Ordinances 1996-22, 1996-34, 2017-10 and 2018-16 to allow additional faade signs for Lot 1 out lot; oTo amend the Final Landscape Plan adopted by Ordinance 1993-45, Exhibit VII and subsequently amended by Ordinance 2017-10; oTo amend the Final Site Plan and parking requirements adopted by Ordinance 1993-45, Exhibit VI and subsequently amended under Ordinance 2003-20 and Resolution 2018-01 for Lot 1; oFinal Planned Unit Development Site Plan approval for on out lot on Lot 1. NOTICE IS ALSO GIVEN that a Public Hearing to consider said request will be held before the Planning and Zoning Commission on October 29, 2019, at Geneva City Hall, 109 James Street, Geneva, Illinois, at 7:00 p.m. All interested parties are invited to attend the public hearing. Provided they register and are sworn in by the Chairman, all interested parties are also invited to present testimony for or against the application and cross-examine witnesses presenting testimony for or against the application.
