AREA NUMBER 9, FOX POINTE SUBDIVISION, KANE COUNTY, ILLINOIS
A. NOTICE IS HEREBY GIVEN that on July 7, 2025, at 7:00 p.m., at the Village of Elburn Village Hall, 301 E. North Street, Elburn, Illinois 60119, a public hearing (the "Hearing") will be held by the Village of Elburn, Illinois, before the Village President and Board of Trustees at which time any interested person may file with the Village Clerk written objections to and may be heard orally in respect to the proposed establishment of the Village of Elburn Special Service Area Number 9, and the levy of taxes on property within the Special Service Area for the purpose of paying the costs of providing special services in and for such Special Service Area. The current territory of the subject property of Special Service Area No. 9 is described below:
Legal Description of subject property for proposed SSA 9:
THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 29 AND THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 32 (EXCEPTING THEREFROM THAT PART THEREOF LYING IN PRAIRIE VALLEY NORTH SUBDIVISION PER DOCUMENT 1999K100746 AND ALSO EXCEPTING THE SOUTHERLY 148 FEET OF SAID NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SAID SECTION 32 LYING WESTERLY OF LOT "A" IN SAID SUBDIVISION) ALL IN TOWNSHIP 40 NORTH, RANGE 7 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN CAMPTON TOWNSHIP, KANE COUNTY, ILLINOIS.
ALSO THAT PART OF ILLINOIS ROUTE 47 ALONG AND ADJOINING THE ABOVE DESCRIBED PROPERTY.
B. The purpose of the SSA is to provide special services to the area, which services are unique and in addition to the services generally provided by the Village. The list of services the SSA may provide from time to time include the following:
Generally to provide special municipal services to the area, including, but not limited to, municipal services in connection with maintaining and operating the following public improvements: parks, open space, and storm water management facilities, including, but not limited to, storm water detention and retention basin areas, pond aerators, inlet and outlet structures, connection storm sewers, connecting surface drainage channels, and subsurface drainage systems. It is the specific intent of the Village that the property owner's association, to-wit: Fox Pointe Owners Association, LLC, shall be responsible for the repair, maintenance and renewal of all parks and open space, including recreational facilities located thereon, and for all stormwater facilities, including but not limited to the care, maintenance and replacement of all landscaping, inlets and outlets and other appurtenant structures associated with the stormwater facilities. Further, it is proposed that in the event, after due notice of any deficiencies by the Village that the Association fails to repair, maintain, or renew the parks, open spaces, or stormwater facilities in accordance with the Village's Stormwater Management Ordinance, the Village shall be entitled to levy such special service area taxes to cause the remediation of such deficiencies and maintain the stormwater facility.
C. The cost of the services for this SSA shall be paid for from the revenue from the levy of a direct annual ad valorem tax upon all taxable property within the SSA for an indefinite period of time. Said tax rate shall be at an amount not to exceed one dollar and fifty cents ($1.50) per one hundred dollars assessed valuation of each tax parcel within the SSA. Said taxes are to be in addition to all other taxes permitted by law.
D. All interested persons, including all persons owning taxable real property located within the Area, will be given an opportunity to be heard at the Hearing regarding the amendment and geographical enlargement and expansion of services of the SSA and the proposed tax levy and an opportunity to file objections to the establishment of the SSA or to the amount of the tax levy. At the Hearing, any interested person may file with the Village Clerk written objections to and may be heard orally in respect to any issues referenced in this notice. The Hearing may be reconvened to another date without further notice other than a motion to be entered upon the minutes fixing the time and place it will reconvene.
E. If a petition signed by at least 51% of the electors residing within the SSA, and by at least 51% of the owners of record of the land included within the boundaries of the SSA area is filed with the Village Clerk within 60 days following the final adjournment of the Hearing objecting to this ordinance for the establishment of the SSA, it shall not be implemented., posted 06/17/2025
