RESOLUTION 2025-046-R
RESOLUTION AUTHORIZING THE SALE OF MUNICIPALLY OWNED REAL ESTATE WEST OF 122 S VAN BUREN STREET
WHEREAS, the City of Batavia (“Cityâ€) has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals and welfare; and
WHEREAS, the City owns property directly west of 122 S Van Buren Street that is former railroad right-of-way and now is being used in part for public utilities and drainage; and
WHEREAS, the City has determined that parts of this parcel are surplus and is no longer needed for municipal purposes; and
WHEREAS, the area considered to be surplus is approximately 535 square feet in size, consisting of a triangular parcel adjacent to the existing railroad right-of-way, east of Van Buren Street and is directly west of 122 S Van Buren Street, identified as part of PIN 12-23-177-023, legally described in Exhibit “A†(“Subject Propertyâ€); and
WHEREAS, the Subject property is vacant and is zoned R1-H High Density Single Family District; and
WHEREAS, the City is advertising this property for sale subject to bids being at least 80% of the appraised value of $535.00; and
WHEREAS, the City will reserve public utility and drainage easement along the entire property being sold, and will convey the property via a Quit Claim Deed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Batavia, Kane and DuPage Counties, Illinois, as follows;
SECTION 1. The recitals set forth above are incorporated in this Resolution as the material findings of Mayor and City Council.
SECTION 2. The City of Batavia has determined that the Subject Property identified as part of PIN 12-23-177-023 and legally described in Exhibit “A†is declared surplus and is no longer needed for municipal purposes.
SECTION 3. The City of Batavia is advertising this parcel for sale at an appraised price of $535.00, and may accept the best offer that is not less than 80% of this value, subject to approval by the City Council. The City reserves the right to reject any or all offers if they are not in the best interest of the City.
SECTION 4. This Resolution shall be published in a newspaper of local circulation after passage.

That part of Lots 5 and 6 in Block 12 in Judge Wilson’s Heirs Addition to Batavia described as follows: Beginning at a point on the North line of said Lot 5 that is 8.25 feet East of the Northwest corner of said lot; thence South 00 Degrees 32 Minutes 47 Seconds East, parallel with the West line of said lot, 34.49 feet to the West line of property described in Document 2005K052376; thence North 32 Degrees 45 Minutes 26 Seconds East along said West line, 41.43 feet to said North line; thence South 89 Degrees 06 Minutes 39 Seconds West along said North line, 22.75 feet to the point of beginning, all in the City of Batavia, Kane County, Illinois.
The property as described is advertised for sale to the highest bidder but at a price no less than 80% of the appraised value of $535.00. The property is to be sold as-is and where-is without any warranties or representations. The City will reserve a public utility and drainage easement across the entire property sold, and will convey the property by Quit Claim Deed. The property is approximately 535 square feet in area, is vacant and is zoned R1-H High Density Single Family District.
The City will accept sealed bids for the real estate until 4:00 PM Thursday, May 1, 2025. Bids will be opened at that time and referred to the City Council for review and potential awarding of a bid for the property. The City reserves the right to reject any and all bids and to waive any formalities or technicalities in the bidding.
